Terms of Service

1. Introduction

Thank you for using Court Clerk (“Service”). These Terms of Service (“Terms”) are a legal agreement between you and Court Clerk Technologies, Inc. (“we,” “us,” or “our”), governing your access to and use of the Service at https://courtclerk.ai.

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. No Legal Advice

The Service provides AI-assisted drafting aids, summaries, and organizational tools. We are not a law firm, and the Service does not provide legal advice. No attorney-client relationship is formed. You are responsible for reviewing all outputs and consulting a licensed attorney as needed.

3. Eligibility & Accounts

  • You must be at least 18 years old to use the Service.
  • You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account, including access granted to collaborators.

4. Acceptable Use

When using the Service, you agree not to:

  • Upload unlawful, harmful, or infringing content.
  • Reverse engineer, scrape, or circumvent rate limits or security protections.
  • Use the Service to provide legal advice unless you are licensed and comply with applicable law and ethics rules.

5. Subscriptions, Billing & Trials

  • We offer Free and Pro plans. Plan details and pricing are shown on /pricing.
  • By subscribing, you authorize us (via our payment processor, such as Stripe) to charge your payment method on a recurring basis until you cancel.
  • You can cancel anytime; access remains until the end of the billing period.
  • Fees are generally non-refundable unless required by law.

6. Intellectual Property

  • We own the Service, including software, trademarks, branding, and content, except where third-party materials are used under license.
  • You own the content you upload (“Customer Content”). You grant us a limited license to process Customer Content to provide the Service (for example, OCR, embeddings, AI analysis, and exports).

7. Third-Party Services

The Service integrates with trusted providers (including Clerk for authentication, AWS S3 for storage, OpenAI for AI, Upstash/Redis for queues, Stripe for billing, and Resend for email). Your use of these providers may also be governed by their terms and privacy policies.

8. Privacy

Our data practices are described in our Privacy Policy. You are responsible for ensuring you have a lawful basis to upload any personal data and for honoring deletion or export requests for data you control.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. AI OUTPUTS MAY BE INACCURATE OR INCOMPLETE. YOU ARE RESPONSIBLE FOR VALIDATING ALL OUTPUTS BEFORE RELYING ON THEM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violations of these Terms or if required by law. Upon termination, your license to use the Service ends immediately.

12. Governing Law & Disputes

These Terms are governed by the laws of California, without regard to conflicts of law. Venue and jurisdiction lie in Irvine, California.

13. Changes

We may update these Terms. Material changes will be posted on the site with an updated effective date. Continued use of the Service after changes constitutes acceptance.
